Terms of Service
1. Who these terms apply to
These Terms of Service ("Terms") govern the use of the services provided by Say Less Media ("we", "us"), a social media management service operated by a sole operator based in Brașov, Romania. By engaging us as a client, or by connecting a social media account to our service, you agree to these Terms.
2. The service
Say Less Media schedules, publishes, and manages social media content on behalf of its clients, and reports on its performance. We operate exclusively through each platform's official APIs and authorization mechanisms (such as TikTok Login Kit and the Content Posting API, or Meta's Graph API), within the permission scopes the account owner grants. We do not request or store account passwords.
3. Account authorization
By connecting a social media account, you confirm that:
- you are the owner of that account, or are duly authorized by its owner to grant us access;
- you authorize us to perform the actions covered by the granted permission scopes — typically publishing approved content and reading the account's profile and performance data;
- you understand you can revoke this access at any time through the platform's own settings, and that revocation ends our ability (and obligation) to operate that account.
4. Client responsibilities
- You retain full ownership of and responsibility for the content you provide. You confirm you hold all rights needed for it to be published (including music, image, and likeness rights).
- You are responsible for ensuring your content and instructions comply with applicable law and with each platform's terms of service and community guidelines.
- You must not use our service for unlawful content, spam, deceptive practices, or any activity prohibited by the platforms we publish to. We may refuse or stop publishing content that, in our judgment, violates this section.
5. Our responsibilities
- We publish only content you have provided and approved, to the accounts you have connected.
- We operate within each platform's developer terms and use official APIs only.
- We safeguard access credentials as described in our Privacy Policy, including encryption at rest for access tokens.
6. Fees
Fees, scope, and schedules are agreed individually with each client in writing (including by email) before work begins. Unless agreed otherwise, fees are invoiced as specified in that agreement.
7. Intellectual property
Clients retain all rights to their content. You grant us a limited, revocable license to store, process, and publish that content solely to provide the service. The Say Less Media name, mark, and website content are ours and may not be reused without permission.
8. Third-party platforms
The social media platforms we publish to are independent services with their own terms, and we do not control them. We are not responsible for platform-side actions such as content removal, account restrictions, API changes, or outages, although we will inform affected clients and adapt where reasonably possible.
9. Liability
We provide the service with professional care, but to the extent permitted by law, our total liability for any claim arising out of the service is limited to the fees you paid us for the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits or lost audience reach. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights under EU and Romanian law.
10. Termination
Either party may end the engagement with written notice as set out in the individual client agreement. Upon termination, we cease all activity on your accounts, and delete associated access tokens and data as described in our Privacy Policy. You can also end our access to any account immediately, at any time, by revoking it in the platform's settings.
11. Changes to these terms
We may update these Terms from time to time. The current version is always available on this page. Material changes affecting active clients will be communicated directly and apply from the date stated in that communication.
12. Governing law
These Terms are governed by the laws of Romania. Disputes are subject to the jurisdiction of the competent courts of Brașov, Romania, without prejudice to any mandatory consumer protections that grant you rights in your own country of residence within the EU.
